DETAILED DESCRIPTION OF GOOD AND / OR SERVICES

Max Motorsport is a business in the Automotive industry that markets a wide range of aftermarket car accessories, lamps, performance parts, car audio, alloy mag wheels and replacement parts. By undertaking to purchase any product from Max Motorsport the customer must abide by the terms and conditions listed herein.

DELIVERY POLICY

Subject to availability and receipt of payment, requests will be processed and shipped usually within 3 to 7 working days and delivery confirmed by way of booking [Number / Voucher / ID etc]. This time frame could change without notice, however should there be any unfortunate delays, you will be notified. Should a product be out of stock, you will be notified and offered a suitable replacement, an option to wait a few more days or a complete refund. Customers can opt to collect orders from our Durban store. Collection can only be made during normal trading hours, once we have prepared your order.Ā 

Orders will only be processed once payment has cleared and reflects into our account. Once cleared and processed, will your order be ready to collect from our store or sent out via courier.

DISCLAIMER:
Online purchases do not include transit insurance unless expressly requested and paid for by the customer prior to dispatch. Max Motorsport accepts no responsibility or liability for any loss, theft, or damage to goods occurring while in transit or once collected by courier services. All risk passes to the purchaser upon collection by the courier.

DELIVERY & CLAIMS POLICY

All online orders involving delivery must be thoroughly inspected before signing the waybill.Ā By signing the waybill, the customer acknowledges that the goods have been received in good condition.

In the event of damage or missing parts on insured orders, do not accept the delivery and do not sign the waybill. The parcel must be immediately returned to the courier and our store must be notified within 24 hours of the damage or missing parts .

A formal report must be submitted to Max Motorsport within 24 hours, accompanied by clear photos and/or videos of the parcel and any visible damage. Adherence to these timelines is essential for any claim to be considered.

Max Motorsport will assist in lodging a claim with the courier company; however, we cannot guarantee the outcome of any claim. The standard claim process may take 4–6 weeks to complete.

Please note that no replacement, refund, or continuation of the order will occur until the courier’s claim process has been finalized.

IN-STORE COLLECTION

All online orders are processed Monday to Friday, and a processing period of 2 to 5 business days should be allowed. Orders will only be released within 2 to 3 days of receipt of the order and only once an official collection or pick-up notification has been sent. Orders placed on weekends or public holidays for in-store collection will receive a pickup notification at the start of the following work week. Online orders for in-store collection may be collected during our operating hours from Monday to Saturday, provided that the official notification has been received.

Prior arrangements must be made for Sunday and Public Holiday collections, as our online department is closed on these days. In the event of couriers collecting on behalf of a customer, the customer must notify us in advance and provide the courier’s name and details. Couriers are required to present the order number as a reference when collecting; failing this, the order will not be released. No order will be handed over without a valid collection or pick-up notification.

FREE SHIPPING ITEMS

Items that are advertised as FREE SHIPPING will be available for a limited period only & will be clearly stated on our website. Terms & Conditions apply on such items and are subject to change without notice. Quantities of these items will also be limited and we reserve the right to stop/pause this offer should stocks be depleted before the end of the promotional date. Full Refunds will be issued on paid up orders if the item is sold out. FREE SHIPPING will be subjected to deliveries to main provincial city centers only & excludes outlying areas not serviced by our nominated courier service provider. FREE SHIPPING orders will be processed and shipped out within 7-10 days after payment has been confirmed into our company bank account. Should a correctly supplied product be returned, there will be a 10% handling fee and the customer will also bear the shipping costs of returning the product back to us. By purchasing the FREE SHIPPING item you abide by the rules & regulations listed herein.

Return and Refunds Policy

Radio's, Amplifiers, Equalizers & Crossovers - These carry a supplier backed repair-warranty, Of 3 months, while we do not swop out any faulty units, Max Motorsport will send the unit to the specific manufacturer for a warranty claim, this normally takes approximately 14 to 21 working days.

Double Din Units - These carry a supplier backed repair-warranty, Of 6 months, while we do not swop out any faulty units, Max Motorsport will send the unit to the specific manufacturer for a warranty claim, this normally takes approximately 14 to 28 working days.

Speakers, Subwoofers, Tweeters, Split Systems & DVR / Reverse Cameras DO NOT carry any warranty, unless specifically stated on the product description. All Speakers, Subwoofers, Tweeters & Split Systems & DVR / Reverse Cameras are tested in-store before leaving our physical store or before being shipped out to online customers.

All Audio items must be installed / fitted by an approved/accredited fitment centre. Approved/accredited fitment receipt are required for warranty claims. Failure to comply with this will void all warranties on such products. DIY installations will void any warranty.

Electronic items that carry a warranty and that have been fitted into clients vehicles cannot be returned with any physical marks/damages. All products must be sent back with the original undamaged packaging any missing components may void the products warranty.

Max Motorsport undertakes to supply all products in good faith. If a product is sold and it is not suitable or incorrect for the vehicle intended, we will gladly refund and or return the product in question. However, correctly supplied products will incur a 10% service fee should the product be returned for whatever reason. All correctly supplied products returned for refunds, must be received by us in the original condition together with the original packaging that it was supplied as well as proof of purchase. Further, all courier/shipping charges for returns on correctly supplied products will be carried by the buyer. Max Motorsport will not be liable for any courier costs as a result of returns on correctly supplied products.

For In-store purchases, it isĀ mandatory for all goods to be checked by the customer BEFORE leaving the store as we will not held responsible for any claims on goods that have been checked / tested after it has left the store. Responsibility of ALL products pass onto the customer once it leaves our store.

Warranty Void: Any self-installation, DIY fitment, or non-RMI approved fitment on electrical/audio products will invalidate the warranty.

No Warranty of Aftermarket Products

These aftermarket non-OEM products are sold on an "as-is" basis. These products are intended for off-road use only. Designed for improved aesthetics and/OR performance, these products can be damaged by harsh off-road impacts. The user assumes all risk for fitting and usage. We will not be liable for structural failures/damages caused by extreme off-road, misuse, or improper installation. No DIY/self fitment. There are NO WARRANTIES on these aftermarket products.

Parallel Import (ā€œGreyā€) Goods Policy

  • Some products sold on Max Motorsport may be parallel imports, also known as ā€œgreyā€ goods.
  • These are genuine branded items legally imported from international markets, not through the authorized South African distributor or agent.
  • Ā While the products are authentic, they may not carry any manufacturer warranty or after-sales support from the local distributor.
  • Distributor & their suppliers assumes responsibility for warranty claims, support, and customer service for such items, in accordance with the Consumer Protection Act.

PEACH / PAYFLEX PAYMENT METHOD

Peach / Payflex is an external payment portal option available to all customers. Where a customers elects to make use of these methods of payments he/she understands and accepts that service chargers may be applicable. Any payment shortfalls or additional charges shall be for that customer's account against those service providers.

Max Motorsport shall not be liable for discrepancies in payment or additional charges levied in transactions when customers make use of the Peach / Payflex platform and services. Max Motorsport shall not be liable for improper use on customers credit cards and debit cards. The customer is liable for all payments made with there payment methods.


ACCURACY, COMPLETENESS & TIMELINESS OF INFORMATION

We are not responsible if information made available on this site is not accurate, complete or current. The material on this site is provided for general information only and should not be relied upon or used as the sole basis for making decisions without consulting primary, more accurate, more complete or more timely sources of information. Wheel Fitment & Warranty Disclaimer

  • Pre-Installation Check: All rims must be inspected by a professional fitment center before tires are mounted.

  • Accessories: Customers are responsible for sourcing necessary spigot rings, lock nuts, wheel nuts, or spacers required for proper vehicle fitment.

  • Quality Assured: All rims undergo a quality check prior to dispatch. Center caps and decals are included.

  • Professional Fitment: We strongly advise having your wheels installed at an accredited fitment center to ensure safety and performance.

  • Warranty Policy: Please note that warranties are voided once wheels have been balanced or tires have been mounted.

LAMPS/LIGHTING & BULBS

These products DO NOT carry any warranties once tested in-store and the product leaves our store. We recommend that these products be installed by a professional fitter. Max Motorsport will however honour any Warranty/Guarantee for these products should they be fitted by ourselves/in-store or in our fitment centre.

CHROME PRODUCTS

Ā There is absolutely NO Guarantee/Warranty on any chrome or chrome plated products.Ā 

SPOILERS & BODY KITS

Max Motorsport endevours to supply products that fit correctly on the vehicle it is intended for. This applies to ALL Spoilers, Bumpers and Body kits. It is the responsibility of the customer to ā€œtrial fitā€ any of these products BEFORE it is spray painted and/or installed. Max Motorsport will not be held responsible for any painting/labour costs directly or indirectly incurred by the customer. We strongly suggest an authorized panel beater be used for the installation of these products.

RETURN POLICY

All products deemed to be incorrect have a 7 day money back guarantee – provided that:

  • The product has not been used in any way,
  • Is in its original condition and packaging
  • Original proof of payment/ invoice is furnished
  • Goods correctly supplied and returned after this period are subject to a 10% handling fee.
  • Lamps/Lighting & Bulbs as well as electrical products will not be refunded or swopped out.
  • Max Motorsport will not be liable for any courier costs / collection as a result of returns on correctly supplied products.

REFUND POLICY

Refunds are generally processed to the original payment method (e.g., credit card, EFT) within 5-7 business days after inspection of return and / or customer requests a refund. Peach payment refunds may take between 2 -10 business days for the funds to reflect in the customers account. While Peach payments processes the refund successfully, the banks are executing the refunds in batches periodically. This period can vary from bank to bank. Payflex payment refunds typically take up to 7 business days. For full returns, any instalments already paid are refunded, and remaining payments are cancelled.

CUSTOMER PRIVACY POLICY

Max Motorsport shall take all reasonable steps to protect the personal information of users. For the purpose of this clause, "personal information" shall be defined as detailed in the Promotion of Access to Information Act 2 of 2000 (PAIA). PAYMENT OPTIONS ACCEPTED

Payment may be made via Visa, Master Card, American Express credit cards or by EFT and direct bank transfer into the Max Motorsport bank account, the details of which will be provided on request. NOTE: All cash deposits incur a mandatory 2% cash deposit fee therefore we strongly suggest EFT payments.Ā Prices on ONLINE deals may vary from our physical store prices.Ā 


CREDIT CARD ACQUIRING AND SECURITY

Credit card transactions will be acquired for Max Motorsport by Virtual Card Service (Pty) Ltd who are the approved payment gateway for First National Bank of South Africa. ShopDirect uses SSL3 and credit card information is stored per Visa and Mastercard guidelines on the website. Users may go to www.shopdirect.co.za to view their security certificate and security policy.


CUSTOMER DETAILS SEPARATE FROM CARD DETAILS

Customer details will be stored by Max Motorsport separately from card details which are entered by the client. All information is strictly confidential and will be protected.


MERCHANT OUTLET COUNTRY AND TRANSACTION CURRENCY

The merchant outlet country at the time of presenting payment options to the cardholder is South Africa. Transaction Currency is ZAR (South African Rand).


RESPONSIBILITY

Max Motorsport takes responsibility for all aspects relating to the transaction including sale of goods and services sold on this website, customer services and support, dispute resolution and delivery of goods.


COUNTRY OF DOMICILE

This website is governed by the laws of South Africa and Max Motorsport chooses as its domicilium citandi et executandi for all purposes under this agreement, whether in respect of court process, notice, or other documents or communication of whatsoever nature, SHOP U14 CITY VIEW CENTRE,UMGENI ROAD,DURBAN, SOUTH AFRICA.


VARIATION

Max Motorsport may, in its sole discretion, change this agreement or any part thereof at any time without notice.
