TERMS & CONDITIONS OF SALE AND WEBSITE USE

These Terms and Conditions govern the use of the Max Motorsport website, all online and in-store purchases from Max Motorsport, the supply of products by Max Motorsport, and all related transactions between Max Motorsport and its customers.

Please read these Terms carefully before purchasing any product.

By accessing this website, placing an order, making payment, accepting delivery, collecting goods, or purchasing from Max Motorsport, you acknowledge that you have read and understood these Terms and agree to be bound by them, subject always to any rights that cannot lawfully be excluded under South African law.

Throughout these Terms, “Max Motorsport”, “Max”, “we”, “us” and “our” refer to Maxspeed Motorstyling CC trading as Max Motorsport.

“Customer”, “you” and “your” refer to the person or entity purchasing goods, using the website or otherwise transacting with Max Motorsport.


2. NATURE OF OUR PRODUCTS

Max Motorsport operates in the automotive aftermarket industry and supplies products that may include:

  • alloy wheels and rims;

  • tyres;

  • automotive lighting;

  • bulbs and LED products;

  • vehicle electronics;

  • radios and multimedia systems;

  • amplifiers and audio equipment;

  • speakers and subwoofers;

  • cameras and related accessories;

  • spoilers;

  • body kits;

  • bumpers;

  • grilles;

  • nudge bars and roll bars;

  • fibreglass products;

  • interior and exterior accessories;

  • styling products;

  • performance products;

  • replacement parts; and

  • other automotive accessories.

Unless expressly represented as an original equipment manufacturer (“OEM”) product, products sold by Max Motorsport may be aftermarket products.

Aftermarket products may differ from OEM components in design, material, manufacturing method, tolerances, finish, colour, dimensions or installation requirements.

The fact that an aftermarket component requires reasonable professional adjustment, preparation or fitment does not, by itself, establish that the product is defective.


3. APPLICATION OF SOUTH AFRICAN LAW

These Terms are governed by the laws of the Republic of South Africa.

Nothing contained in these Terms is intended to exclude, restrict or waive any consumer right that may not lawfully be excluded, restricted or waived.

Where applicable, transactions may be subject to legislation including the:

  • Consumer Protection Act 68 of 2008 (“CPA”);

  • Electronic Communications and Transactions Act 25 of 2002 (“ECTA”);

  • Protection of Personal Information Act 4 of 2013 (“POPIA”); and

  • other applicable South African legislation.

Where a provision of these Terms conflicts with a mandatory provision of applicable law, the mandatory provision of law will prevail to the extent of that conflict, and the remaining provisions of these Terms will continue to apply.


4. PRODUCT INFORMATION AND WEBSITE IMAGES

We make reasonable efforts to ensure that product descriptions, specifications, prices, photographs and compatibility information are accurate.

However, photographs and illustrations are generally intended as representations of products.

Actual products may differ slightly in:

  • colour;

  • shade;

  • texture;

  • finish;

  • packaging;

  • branding placement;

  • design details;

  • dimensions;

  • accessories supplied; or

  • appearance.

Screen settings, lighting and photography can also affect how colours and finishes appear online.

Manufacturers and suppliers may change packaging, specifications or minor design elements without prior notice.

Where a specific specification is critical to your purchase, you should confirm it with Max Motorsport before ordering.


5. VEHICLE COMPATIBILITY AND CUSTOMER RESPONSIBILITY

Automotive parts frequently vary according to vehicle:

  • make;

  • model;

  • year;

  • derivative;

  • body shape;

  • engine;

  • trim level;

  • facelift/pre-facelift configuration;

  • wheel specification;

  • factory options; and

  • modifications previously made to the vehicle.

The customer is responsible for providing accurate vehicle information.

Where requested, this may include VIN/chassis information, photographs, measurements or other identifying information.

If you independently select a product without obtaining written fitment confirmation from Max Motorsport, you accept responsibility for verifying compatibility before installation.

A product being advertised for a particular vehicle model does not necessarily mean that it will fit every derivative, specification or modified version of that vehicle.


6. PROFESSIONAL FITMENT

Automotive products should be installed by appropriately qualified and experienced professionals.

Where applicable, Max Motorsport may require installation by an accredited or appropriately qualified automotive, audio, tyre, wheel, auto-electrical, panel-beating or fitment facility.

The customer is responsible for ensuring that an installer is competent to install the relevant product.

Where a warranty claim relates to an installed product, Max Motorsport may reasonably request:

  • the installer's invoice;

  • the installer's details;

  • installation photographs;

  • diagnostic information;

  • vehicle details;

  • proof of professional installation; and

  • any other information reasonably necessary to investigate the claim.

Damage resulting from incorrect installation, unauthorised modification, misuse or installation contrary to supplied instructions is not considered a manufacturing defect.


7. BODY KITS, SPOILERS, BUMPERS AND EXTERIOR COMPONENTS

All body kits, spoilers, bumpers, lips, grilles, fibreglass products and similar exterior products must be fully inspected and trial-fitted before painting or permanent installation.

The installer must confirm alignment and suitability before:

  • painting;

  • wrapping;

  • drilling;

  • cutting;

  • trimming;

  • sanding;

  • bonding;

  • welding;

  • modifying; or

  • permanently attaching the product.

Some aftermarket body components may require professional preparation, adjustment, trimming or alignment during installation.

If a fitment concern exists, installation must stop and Max Motorsport must be contacted before the product is altered.

Once a product has been materially altered, painted or permanently installed, Max Motorsport may be unable to determine its original supplied condition.

To the maximum extent permitted by law, Max Motorsport is not responsible for consequential fitment expenses arising from circumstances outside its control, including panel-beating, painting, wrapping, removal, installation or reinstallation charges, unless liability for such costs cannot lawfully be excluded.

Customers are strongly advised to use a reputable professional panel beater or fitment centre.


8. WHEELS AND RIMS — IMPORTANT PRE-FITMENT REQUIREMENT

All wheels must be inspected before tyres are mounted.

Before mounting tyres, the customer or professional fitment centre must verify:

  • wheel size;

  • width;

  • PCD;

  • offset;

  • centre bore;

  • brake clearance;

  • vehicle clearance;

  • physical condition;

  • finish;

  • quantity; and

  • general compatibility.

DO NOT MOUNT A TYRE IF THERE IS A VISIBLE DEFECT, DAMAGE OR FITMENT CONCERN.

Contact Max Motorsport before proceeding.

Depending on the vehicle and wheel combination, additional components may be required, including:

  • spigot rings;

  • wheel nuts;

  • wheel bolts;

  • lock nuts;

  • spacers; or

  • other fitment components.

Unless expressly included in the sale, such components may need to be purchased separately.


9. WHEEL DAMAGE AFTER FITMENT

Wheels can be damaged by external forces.

Subject to applicable statutory rights, damage caused by matters such as the following is not regarded as a manufacturing defect:

  • potholes;

  • kerbing;

  • road impact;

  • accidents;

  • collision;

  • overloading;

  • incorrect tyre pressure;

  • incorrect tyre sizing;

  • incorrect installation;

  • incorrect wheel nuts or bolts;

  • improper torque;

  • misuse;

  • racing or competition;

  • negligent driving;

  • suspension defects;

  • vehicle modification; or

  • other external impact.

A wheel warranty claim may require technical inspection before the cause of failure can be determined.


10. ELECTRICAL, ELECTRONIC AND AUDIO PRODUCTS

Electrical and electronic products must be installed correctly and in accordance with manufacturer requirements.

Products may be tested before dispatch or collection where reasonably practicable.

A warranty does not cover damage resulting from matters such as:

  • incorrect installation;

  • incorrect wiring;

  • reversed polarity;

  • incorrect voltage;

  • short circuits;

  • water ingress;

  • physical damage;

  • incorrect grounding;

  • damaged vehicle wiring;

  • electrical surges;

  • tampering;

  • unauthorised modification;

  • misuse; or

  • installation contrary to instructions.

Where professional installation is required by the manufacturer, supplier or Max Motorsport, proof of such installation may be required for a warranty claim.


11. SUPPLIER WARRANTIES

Certain products may carry additional supplier or manufacturer-backed warranties.

The applicable warranty period may differ according to the product.

Where an additional supplier warranty applies, its terms will be communicated on the product listing, invoice, packaging or accompanying documentation where reasonably practicable.

A supplier warranty is additional to, and does not replace, statutory rights that apply under South African law.

A product submitted under a supplier warranty may need to be sent to the manufacturer, importer, distributor or authorised repair facility for assessment.

Assessment and repair periods are estimates and may depend on the relevant third party.


12. AFTERMARKET PRODUCTS

Unless otherwise stated, aftermarket products are not represented as OEM products.

Certain products may be intended primarily for styling, modification, performance or specialised applications.

The customer is responsible for ensuring that the product and intended modification comply with any applicable:

  • vehicle safety requirements;

  • road traffic requirements;

  • insurance conditions;

  • manufacturer requirements; and

  • other applicable regulations.

Max Motorsport does not warrant that every aftermarket modification will be accepted by a vehicle manufacturer, insurer, finance provider or regulatory authority.


13. PARALLEL IMPORT / “GREY” GOODS

Certain products may constitute parallel imports or “grey goods”.

Where applicable, these products may be genuine branded products sourced outside the manufacturer's authorised South African distribution channel.

Accordingly, an authorised South African distributor may not provide its usual local manufacturer warranty or after-sales service.

Where a product is identified as a parallel import, Max Motorsport will administer applicable rights and any warranty available through the relevant importer/supplier, subject to applicable South African law.


14. ORDERS

Placing an order constitutes an offer by the customer to purchase the selected products.

An automated order acknowledgement does not necessarily constitute final acceptance of an order.

Max Motorsport reserves the right, subject to applicable law, to decline or cancel an order where, for example:

  • payment has not been received;

  • payment cannot be verified;

  • fraud is suspected;

  • the product is unavailable;

  • a material pricing or listing error occurred;

  • delivery is not reasonably possible;

  • the order violates these Terms; or

  • fulfilling the order would be unlawful.

Where Max Motorsport cancels a fully paid order in circumstances requiring repayment, the amount lawfully due to the customer will be refunded.


15. STOCK AVAILABILITY

All products are subject to availability.

Website inventory may not always update instantaneously where products are simultaneously sold online and in-store.

If a product becomes unavailable after ordering, Max Motorsport may, depending on the circumstances and with the customer's agreement:

  • offer an alternative product;

  • place the product on backorder;

  • provide an estimated availability date; or

  • cancel and refund the affected item.


16. PRICING ERRORS

Max Motorsport makes reasonable efforts to ensure that pricing is correct.

However, genuine typographical, system, data-feed or obvious pricing errors may occur.

Where a product has been displayed at an incorrect price, Max Motorsport may take any action permitted by applicable law, which may include correcting the error and contacting the customer before fulfilment.

Nothing in this clause limits any rights or obligations arising from mandatory consumer legislation concerning displayed prices.


17. PAYMENT

Orders will generally only be processed after payment has been successfully authorised, received and cleared.

Available payment methods may include:

  • Visa;

  • Mastercard;

  • American Express;

  • EFT;

  • bank transfer;

  • Peach Payments;

  • Payflex; and

  • other payment methods displayed at checkout.

Payment options may change from time to time.

All transactions are processed in South African Rand (ZAR) unless expressly stated otherwise.

Cash deposits may attract a bank/cash-deposit fee where disclosed.


18. THIRD-PARTY PAYMENT PROVIDERS

Where customers use third-party payment or credit providers such as Peach Payments or Payflex, additional terms imposed by those providers may apply.

Max Motorsport is not responsible for fees, interest, account restrictions, payment schedules, authorisation decisions or other matters independently imposed by a third-party payment provider, except where applicable law provides otherwise.

Customers remain responsible for complying with their agreements with those providers.


19. PAYMENT FRAUD AND VERIFICATION

Max Motorsport reserves the right to conduct reasonable fraud-prevention and payment-verification procedures.

We may request reasonable supporting information before releasing high-value or suspicious orders.

Goods will not be released where payment is reversed, fraudulent, unauthorised or has not cleared.

Suspected fraudulent transactions may be reported to the relevant payment provider, bank or law-enforcement authority where appropriate.


20. DELIVERY

Subject to stock availability and cleared payment, orders are generally processed and dispatched within the estimated periods communicated by Max Motorsport.

The existing standard estimate is generally 3–7 working days, although certain products, promotions, special orders, supplier orders or free-shipping orders may require longer.

Delivery estimates are not guarantees unless expressly agreed in writing.

Delivery can be affected by circumstances outside Max Motorsport's reasonable control, including:

  • courier delays;

  • strikes;

  • civil disruption;

  • severe weather;

  • road closures;

  • supplier delays;

  • peak-season volumes;

  • load-shedding or infrastructure failures;

  • natural disasters; and

  • other force majeure events.

Customers will be informed of material delays where reasonably practicable.


21. DELIVERY ADDRESS

The customer is responsible for supplying a complete and accurate delivery address and contact information.

Additional costs resulting from an incorrect address, failed delivery, refusal to accept delivery or repeated delivery attempts may be charged to the customer where legally permissible.


22. COURIER DELIVERY — INSPECTION

Customers should inspect parcels as soon as reasonably possible.

Where packaging is visibly damaged, customers should, where reasonably possible:

  1. photograph or video the packaging;

  2. note visible damage with the courier;

  3. retain all packaging;

  4. inspect the contents promptly; and

  5. notify Max Motorsport as soon as reasonably possible.

We strongly request that visible courier damage, shortages or missing components be reported within 24 hours because courier investigations are time-sensitive.

Failure to report within this requested period may make a courier investigation materially more difficult, but this notification request does not extinguish statutory rights that cannot legally be excluded.

Customers must retain the packaging and evidence while a claim is investigated.


23. DELIVERY RISK

Risk in goods will transfer in accordance with applicable South African law and the circumstances of the transaction.

Where Max Motorsport arranges delivery to a consumer, nothing in these Terms is intended to transfer risk earlier than permitted by mandatory consumer law.

Where a customer independently appoints and contracts with a third-party transporter or courier to collect goods on the customer's behalf, the allocation of risk will be determined in accordance with applicable law and the nature of that arrangement.


24. PRIVATE OR CUSTOMER-ARRANGED COLLECTIONS

Where a customer independently appoints a courier, transporter, driver or other third party to collect goods, the customer must notify Max Motorsport in advance.

The collector may be required to provide:

  • order number;

  • customer name;

  • identification;

  • collection authorisation; and

  • other reasonable verification information.

Max Motorsport may refuse to release an order if it cannot reasonably verify the collector's authority.

Once goods have been lawfully handed to a customer's authorised representative, responsibility thereafter will be determined in accordance with applicable law.


25. IN-STORE COLLECTION

Online collection orders are processed during business days.

Customers must wait for an official Ready for Collection / Pickup Notification before travelling to collect.

An order will not be released merely because an online payment has been made.

Identification, order confirmation or additional verification may be requested before goods are released.


26. FREE SHIPPING PROMOTIONS

Free-shipping promotions:

  • may apply only to selected products;

  • may be limited in duration;

  • may be limited by stock;

  • may apply only to specified areas;

  • may exclude outlying or high-risk areas; and

  • may have specific promotional conditions.

Unless otherwise stated, free shipping does not necessarily mean that Max Motorsport will bear the cost of a voluntary/change-of-mind return.


27. CHANGE-OF-MIND RETURNS

Except where legislation provides otherwise, Max Motorsport is not required to accept a return merely because a customer:

  • changed their mind;

  • no longer wants the product;

  • purchased the incorrect item;

  • found the product cheaper elsewhere;

  • dislikes the appearance after purchase; or

  • selected the incorrect vehicle specification.

Nevertheless, Max Motorsport may, at its discretion or where otherwise required by law, accept qualifying unused products for return.

Any discretionary return must generally be:

  • unused;

  • unfitted;

  • unmodified;

  • undamaged;

  • complete;

  • in original packaging;

  • accompanied by all accessories; and

  • accompanied by proof of purchase.

A reasonable handling/restocking charge may apply to a discretionary return where lawful and disclosed.

Return transportation for a correctly supplied product may be for the customer's account where permitted by law.

This clause does not apply where a customer is exercising a statutory right that prohibits such a charge.


28. DEFECTIVE, UNSAFE OR FAILED GOODS

Nothing in these Terms removes the customer's rights under the Consumer Protection Act where the Act applies.

Where goods fail to satisfy applicable statutory standards, the customer may have remedies provided by law.

In particular, qualifying consumers may have rights concerning defective, unsafe or failed goods during the statutory implied warranty period.

Max Motorsport may inspect or reasonably assess a returned product to determine:

  • the alleged defect;

  • the condition of the product;

  • whether the product has been modified;

  • whether damage arose from installation;

  • whether damage arose from misuse or external causes; and

  • whether the statutory or supplier warranty applies.

Inspection is not intended to deprive a consumer of a remedy available under applicable law.


29. DAMAGE CAUSED AFTER SUPPLY

A warranty does not cover a fault caused after supply by circumstances such as:

  • misuse;

  • abuse;

  • accident;

  • collision;

  • impact;

  • negligent handling;

  • incorrect installation;

  • unauthorised modification;

  • incorrect maintenance;

  • incorrect wiring;

  • water ingress caused after supply;

  • racing;

  • overloading;

  • use outside the product's intended specifications; or

  • alteration contrary to manufacturer/supplier instructions.

This does not affect a customer's rights where the alleged failure was actually caused by a defect for which Max Motorsport is legally responsible.


30. MODIFIED, PAINTED OR INSTALLED PRODUCTS

Customers must inspect goods before modification or installation.

Where a product is:

  • cut;

  • drilled;

  • painted;

  • wrapped;

  • welded;

  • sanded;

  • bonded;

  • wired;

  • programmed;

  • dismantled;

  • modified; or

  • otherwise materially altered,

Max Motorsport may be unable to accept a discretionary return because the product can no longer be resold or assessed in its original supplied condition.

This does not remove statutory remedies where a defect existed and applicable law provides the consumer with a remedy despite such circumstances.


31. RETURN AUTHORISATION

Customers should contact Max Motorsport before sending a product back.

Unauthorised parcels may cause delays in identifying and processing the return.

Customers should provide:

  • order/invoice number;

  • name and contact details;

  • product details;

  • reason for return;

  • photographs/video where relevant; and

  • details of the alleged fault.

Max Motorsport will then provide the appropriate return instructions.


32. RETURN PACKAGING

Returned products must be packaged securely.

Where reasonably possible, original packaging should be retained until the customer has inspected and tested the product.

The customer may be responsible for damage caused by inadequate packaging during a customer-arranged return, subject to applicable law.


33. REFUNDS

Approved refunds will generally be made to the original payment method where reasonably possible.

Following approval, Max Motorsport generally aims to process refunds within approximately 5–7 business days.

Banking and payment-provider processing times are outside Max Motorsport's direct control.

Peach, Payflex and other payment-provider refunds may take additional time to reflect depending on the provider and customer's bank.


34. CANCELLATION OF ORDERS

A customer wishing to cancel an order should contact Max Motorsport immediately.

Cancellation rights depend on:

  • whether the order has already been processed;

  • whether it has been dispatched;

  • whether it is a special-order item;

  • whether work has already commenced;

  • the nature of the transaction; and

  • applicable statutory cancellation rights.

Where Max Motorsport accepts a discretionary cancellation that is not required by law, reasonable costs already actually incurred may be deducted where legally permissible and properly applicable.

Nothing in this clause limits a statutory cancellation right.


35. SPECIAL-ORDER, CUSTOM OR CUSTOMER-SPECIFIC PRODUCTS

Certain products may be:

  • specially imported;

  • specially ordered;

  • custom manufactured;

  • custom painted;

  • cut to specification;

  • programmed;

  • personalised; or

  • procured specifically for a customer's vehicle.

Customers will be informed where reasonably practicable that an item is a special or custom order.

Cancellation or change-of-mind returns may be restricted for such products to the extent permitted by applicable law.

Defective-goods rights remain unaffected where applicable.


36. CHROME AND SPECIAL FINISH PRODUCTS

Chrome, polished, painted and other specialist finishes require appropriate maintenance.

Finish deterioration caused by external factors such as:

  • chemicals;

  • acidic wheel cleaners;

  • incorrect cleaning products;

  • salt;

  • road contamination;

  • abrasive cleaning;

  • impact;

  • scratching;

  • heat;

  • weather exposure; or

  • neglect

does not constitute a manufacturing defect merely because deterioration occurs after exposure.

Any statutory rights concerning an actual manufacturing defect remain unaffected.


37. LIGHTING PRODUCTS

Headlights, taillights, fog lights, bulbs, LED products and similar lighting products must be inspected and tested before permanent installation where reasonably possible.

Professional installation is recommended.

Warranty eligibility will depend on:

  • the product;

  • the applicable supplier warranty;

  • installation;

  • the cause of failure; and

  • statutory rights.

A blanket exclusion of statutory rights does not apply merely because a product is electrical.


38. LABOUR, INSTALLATION AND CONSEQUENTIAL COSTS

Unless Max Motorsport expressly agrees otherwise in writing or applicable law requires otherwise, the price of a product does not include third-party:

  • installation;

  • removal;

  • diagnostics;

  • panel beating;

  • painting;

  • programming;

  • towing;

  • storage;

  • vehicle hire;

  • transport;

  • reinstallation; or

  • downtime costs.

Customers should stop installation and contact Max Motorsport immediately where a suspected defect or incompatibility becomes apparent.

To the maximum extent permitted by law, Max Motorsport will not be responsible for avoidable third-party costs incurred after the customer or installer knew, or reasonably should have known, that there was a product or fitment concern.


39. LIMITATION OF LIABILITY

Nothing in these Terms excludes liability that cannot legally be excluded.

Subject to that qualification and to the maximum extent permitted by law, Max Motorsport will not be liable for indirect, incidental or consequential loss arising from matters outside its reasonable control or from:

  • incorrect installation;

  • misuse;

  • unauthorised modification;

  • incorrect customer-provided vehicle information;

  • use contrary to instructions;

  • road impact;

  • third-party workmanship;

  • third-party service-provider failures; or

  • customer negligence.

Each limitation in these Terms must be interpreted only to the extent permitted by applicable law.


40. CUSTOMER INDEMNITY

To the maximum extent permitted by law, the customer indemnifies Max Motorsport against third-party claims, losses or expenses arising directly from the customer's:

  • unlawful use of a product;

  • negligent installation;

  • unauthorised modification;

  • misuse;

  • false or inaccurate information;

  • breach of these Terms; or

  • infringement of another person's rights,

except to the extent that the loss was caused by Max Motorsport or where such indemnification is prohibited by law.


41. WEBSITE INFORMATION

Website content is provided in good faith.

Max Motorsport may correct:

  • typographical errors;

  • descriptions;

  • specifications;

  • availability;

  • images;

  • promotional information;

  • shipping information; and

  • other website errors.

We reserve the right to update the website as necessary, subject to applicable law.


42. INTELLECTUAL PROPERTY

Unless otherwise indicated, the Max Motorsport website and its original content, branding, layout, graphics and other proprietary material are owned by or licensed to Max Motorsport.

No person may reproduce, scrape, republish, distribute or commercially exploit protected Max Motorsport material without authorisation, except where permitted by law.

Third-party trademarks remain the property of their respective owners.


43. PROHIBITED WEBSITE USE

Customers may not use the website to:

  • commit fraud;

  • attempt unauthorised access;

  • distribute malware;

  • interfere with website security;

  • scrape protected information unlawfully;

  • impersonate another person;

  • make fraudulent payments;

  • violate intellectual-property rights; or

  • engage in unlawful activity.

Max Motorsport may restrict access and take appropriate legal action where misuse occurs.


44. PERSONAL INFORMATION AND POPIA

Max Motorsport processes personal information in accordance with applicable South African privacy legislation, including POPIA.

Personal information may be processed for legitimate purposes including:

  • processing orders;

  • delivering goods;

  • processing payments;

  • customer support;

  • fraud prevention;

  • warranty administration;

  • accounting;

  • regulatory compliance;

  • marketing where lawfully permitted; and

  • improving our services.

Personal information may be shared with service providers where reasonably necessary to perform these functions, including couriers, payment processors, IT providers, professional advisers and suppliers.

Max Motorsport will take appropriate and reasonable measures to safeguard personal information.

45. PAYMENT INFORMATION

Payment-card information is generally processed through third-party payment infrastructure.

Max Motorsport does not intentionally require customers to provide full card credentials directly through ordinary email or WhatsApp.

Customers should never send PINs, passwords or one-time passwords to Max Motorsport.


46. PROMOTIONS

Promotions may:

  • run for limited periods;

  • apply only while stocks last;

  • apply to selected products;

  • be limited to one purchase/customer;

  • contain specific qualifying conditions; and

  • be withdrawn or amended where legally permissible.

Promotional terms must be read together with these Terms.


47. FORCE MAJEURE

Max Motorsport will not be responsible for delay or failure caused by events outside its reasonable control to the extent permitted by law.

These may include:

  • natural disasters;

  • flooding;

  • severe weather;

  • fire;

  • strikes;

  • riots;

  • civil unrest;

  • war;

  • governmental restrictions;

  • epidemics or pandemics;

  • courier network disruption;

  • major telecommunications failures;

  • power infrastructure failures; or

  • supplier disruptions.

Max Motorsport will use reasonable efforts to minimise disruption where practicable.


48. COMPLAINTS AND DISPUTES

Customers are encouraged to first contact Max Motorsport so that the matter can be investigated and an attempt made to resolve it directly.

Please provide:

  • full name;

  • invoice/order number;

  • description of the issue;

  • supporting photographs or videos;

  • installer information where relevant; and

  • the remedy requested.

Nothing in these Terms prevents a consumer from approaching a regulator, ombud, tribunal or court where entitled to do so.


49. GOVERNING LAW AND JURISDICTION

These Terms and all transactions with Max Motorsport are governed by South African law.

Subject to statutory rights regarding jurisdiction and dispute resolution, disputes will be dealt with by a court or other competent body having jurisdiction under South African law.


50. DOMICILIUM

For purposes of formal notices and legal process, Max Motorsport selects:

as its chosen physical address, subject to any updated address subsequently published by Max Motorsport.


51. SEVERABILITY

If any provision of these Terms is held to be invalid, unlawful or unenforceable, that provision will, to the extent possible, be severed or interpreted so as to comply with applicable law.

The remaining provisions will continue to apply.


52. NO WAIVER

A failure or delay by Max Motorsport in exercising a right under these Terms does not automatically constitute a waiver of that right.


53. VARIATION OF THESE TERMS

Max Motorsport may update these Terms from time to time to reflect:

  • changes in legislation;

  • business processes;

  • products;

  • payment methods;

  • courier arrangements;

  • technology; or

  • operational requirements.

The version applicable to a transaction will generally be the version in effect when the relevant transaction is concluded, unless applicable law provides otherwise.


54. ENTIRE AGREEMENT

These Terms, together with the applicable:

  • order confirmation;

  • invoice;

  • product-specific terms;

  • warranty terms;

  • Returns/Refund Policy;

  • Shipping Policy;

  • Privacy Policy; and

  • any expressly agreed written terms

constitute the terms governing the relevant transaction.

Where product-specific written terms legitimately differ from these general Terms, those specific terms will apply to that product to the extent permitted by law.


55. IMPORTANT CUSTOMER ACKNOWLEDGEMENT

By purchasing from Max Motorsport, you acknowledge that:

  1. you have had a reasonable opportunity to read these Terms;

  2. you understand that many Max Motorsport products are aftermarket automotive products;

  3. you are responsible for supplying accurate vehicle information;

  4. professional installation may be required;

  5. body kits and exterior components must be trial-fitted before painting or permanent modification;

  6. wheels must be inspected before tyres are mounted;

  7. products should not be modified or permanently installed where a visible defect or compatibility concern exists;

  8. damage caused by misuse, incorrect installation, modification, impact or other external causes is not automatically a product defect;

  9. discretionary/change-of-mind returns are different from statutory defective-product claims; and

  10. nothing in these Terms removes rights that South African law does not permit Max Motorsport to exclude.
